Essay代写范文:State rights in the US 2019-05-21

State rights in the US, from my own point of view, can be defined as the powers and rights owned by individual US states but not by the federal government. Or maybe it can be put in another way that statesrights are opposite to the rights of the federal government. Different parties have different views toward different issues and they take different stances in front of state rights. Therefore the following will make a compare and contrast of the view of three party platforms, two major political parties Democrat and Republican together with one third party, Libertarian toward three issues health care, economy and environment. At the same time, how these three parties look at statesrights will as well be elaborated on.

When it comes to the view of three parties on health care, what is a must to mention is the Affordable Care Act. And the most obvious difference is that the Republicans are opposed to the Affordable Care Act while the Democrats are in support of the Affordable Care Act. The detailed condition is that the Republicans prefer a patient-centered health care system rather than a government-centered health care system in that patient-centered health care system is based in free markets and it can help decrease the costs of health care and foster competition. In the opposite, the Democrats lay more emphasis on the accessible, affordable and high quality health care in order that all the Americans can be guaranteed good health care. According to this, it can be easily found that the Democrats strengthen health care more than the Republicans. As to the Libertarians, they hold that availability and quality of health care will increase if government interference can be removed and free markets can be enabled. Thus a fair knowledge can be obtained that both the Libertarians and the Republicans pay attention to health care in free markets.

Concerning the view of three parties on economy, the Democrats deem that an economy can only boom under fiscal discipline in that fiscal discipline is a must in allowing an economy to function optimally and grow. However, the Republicans, regardless of the fiscal discipline, believe that each and every American has the right to build, invest, own and prosper and they object to any policy that entrusts the federal government control of industry. From the perspective of the Republicans, business regulations are crucial and they should promote confidence in the economy among both businesses and consumers. What is different is that the Libertarians advocate reducing and eliminating taxes, removing unproductive regulations and limiting government in the way of innovation and job creation (Libertarian National Committee, Inc. 2017).

As for the view of three parties on environment, the Republicans emphases conservation and they ensure public access to public lands for fishing, hunting and recreational shooting. Also, they agree on environmental policies that are tailored to the needs of the localities. The Democrats are committed to environmental protection by protecting Americas natural resources, reducing the effects of climate change and safeguarding the quality of air, land and water for current and future generations. In the meantime, efforts are made to deal with the environmental challenges through investing in clean energy and protecting the ecosystems. While the Libertarians consider that the government is the worst polluter and responsibility and individual rights for air, land, water and wildlife have to be enforced in order to better protect the environment.

Generally speaking, the Republicans promote statesrights and their core principle is that statesrights trump federal powers so that they deem that programs like Obamacare (President Barack Obamas health law) stand for a radical overreach by the federal government (Dan Levine. 2017). However, Democrats desire more policymaking power at the federal level (Mallory E. SoRelle and Alexis N. Walker. 2017). What is the same is that both the Democrats and Republicans have historically preempted or promoted statesrights depending on their partys political goals for a given issue. That is to say, both parties care about statesrights and they have made equal contributions to federal preemption. But what is different is that their ways in federal preemption are different from one another. The detailed case is that the Republicans carry out what are recognized as ceiling preemptionswhile the Democrats conduct by setting floor preemptions, or minimum standards that states are required to meet but can exceed if they like (Mallory E. SoRelle and Alexis N. Walker. 2017).

Another similarity between the Democrats and the Republicans is that both parties believe in statesrights. But they believe statesrights for different issues. On one hand, he Democrats believe statesrights as long as those states do not implement any law that is dangerous to the health of the nation or racist, such as access to education, civil rightslegislation, a womans right to choose and so on. On the other hand, the Republicans support statesrights unless states pass something they do not agree on the below issues: assisted suicide, gay marriage, illegal immigration, medical marijuana, etc. As a result, both parties use federal power to limit state authority.

And the Libertarians support statesrights firstly because state rights are able to restrict the power of the federal government but not they would like to empower state governments. Secondly, state rights can be used to fight against farm subsidies, the federal highway system, housing projects, the New Deal as well as a host of other government programs. Also, state rights can play a part in fighting Communism (Marcus Epstein. 2003). Therefore all these three parties support statesrights to a certain degree.
